a. Entitlement

Are casual employees, workers paid by result, part-time employees entitled to retirement pay?

For the private sector, casual workers, workers paid by result, and part-time employees are entitled to retirement pay. The law does not distinguish as to what kind of an employee is entitled to retirement pay. So long as the conditions are met, an employee is entitled to retirement pay regardless of their status, how they are paid, or how many hours of week they render.

Is retirement pay due to a retired employee who is subsequently rehired as an independent contractor or consultant after retirement?

Yes, retirement pay due to a retired employee who is subsequently rehired as a contractor or consultant after retirement.

The retirement pay is for his service as an employee to the employer. When the employee was subsequent rehired as an independent contractor or consultant after retirement, such work or service is under a principal/client-contractor relationship, and not an employer-employee relationship.
